Giri\u015f 26.5.2003 tarihinde TBMM\u2019ce kabul edilerek 10.6.2003 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile 1475 say\u0131l\u0131 \u0130\u015f Kanunu y\u00fcr\u00fcrl\u00fckten kald\u0131r\u0131larak \u00f6nemli bir \u201ctemel yasa\u201d de\u011fi\u015fikli\u011fi ger\u00e7ekle\u015ftirilmi\u015ftir. 5.7.2003 tarihinde Resm\u00ee Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren 4904 say\u0131l\u0131 T\u00fcrkiye \u0130\u015f Kurumu Kanunu da konumuz a\u00e7\u0131s\u0131ndan b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r. Ayr\u0131ca bu Kanunlar\u0131n uygulanma \u015feklini ve esaslar\u0131n\u0131 d\u00fczenleyen ilgili Y\u00f6netmeliklerin de hem merkez te\u015fkil\u00e2t\u0131 hem de yerel te\u015fkil\u00e2t\u0131m\u0131z taraf\u0131ndan bilinmesi ve uygulaman\u0131n takip edilmesi, h\u00fck\u00fcml\u00fc, tutuklu ve eski h\u00fck\u00fcml\u00fclerin haklar\u0131n\u0131n korunmas\u0131 ve geli\u015ftirilmesi a\u00e7\u0131s\u0131ndan zorunludur. Ayn\u0131 zamanda Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn g\u00f6zetimi alt\u0131nda olan yeti\u015fkin ve \u00e7ocuklar\u0131n da tahliye sonras\u0131nda hangi kurumlar\u0131n kendilerine nas\u0131l yard\u0131mc\u0131 olabilecekleri konusunda fikir sahibi olmalar\u0131, sistemi tan\u0131malar\u0131 ve haklar\u0131n\u0131 bilmeleri yararl\u0131 olacakt\u0131r. H\u00fck\u00fcml\u00fc ve tutuklular\u0131n topluma kazand\u0131r\u0131lmas\u0131 s\u00fcreci tahliye sonras\u0131 ile ba\u011flant\u0131l\u0131 olarak d\u00fc\u015f\u00fcn\u00fclmelidir. Kurum i\u00e7inde verilen e\u011fitimin kalitesi ne kadar iyi olursa olsun, d\u0131\u015f d\u00fcnya ile ba\u011flant\u0131s\u0131 kurulam\u0131yorsa amac\u0131na ula\u015famayacakt\u0131r. Daha a\u00e7\u0131k bir anlat\u0131mla kurum i\u00e7indeki e\u011fitimin ba\u015far\u0131s\u0131 tahliye sonras\u0131nda h\u00fck\u00fcml\u00fc ve tutukluya yapaca\u011f\u0131 katk\u0131yla orant\u0131l\u0131d\u0131r. Bu nedenle Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn g\u00f6zetimi alt\u0131nda bulunan ve \u00e7al\u0131\u015fmas\u0131 gereken yeti\u015fkin ve \u00e7ocuklar\u0131n topluma kazand\u0131r\u0131lmas\u0131 s\u00fcreci; ki\u015finin istihdam \u00f6ncesi e\u011fitilmesi, tahliyesinden sonra i\u015fe yerle\u015ftirilmesi ve takip edilmesi \u015feklinde, \u00fc\u00e7 a\u015famal\u0131 bir s\u00fcreci gerektirmektedir. Merkezde Genel M\u00fcd\u00fcrl\u00fck, ta\u015frada ise Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131 ile kurum m\u00fcd\u00fcrl\u00fckleri kurum i\u00e7i ya\u015fant\u0131y\u0131, ilgili kanun, t\u00fcz\u00fck ve y\u00f6netmelikler \u00e7er\u00e7evesinde yaz\u0131l\u0131 ve s\u00f6zl\u00fc emirleriyle d\u00fczenlemektedirler. Bir anlamda kurum i\u00e7i ya\u015fant\u0131y\u0131 \u015fekillendirmek b\u00fcy\u00fck \u00f6l\u00e7\u00fcde Adalet Bakanl\u0131\u011f\u0131n\u0131n yetkisindedir. Ancak h\u00fck\u00fcml\u00fc ve tutuklular\u0131n tahliye sonras\u0131ndaki ya\u015fant\u0131lar\u0131 konusunda ayn\u0131 \u015feyi s\u00f6ylemek m\u00fcmk\u00fcn de\u011fildir. Bu ortam\u0131 \u00e7ok say\u0131da kurum ve kurulu\u015f, uyum i\u00e7inde ya da birbirlerinden habersiz bir \u015fekilde d\u00fczenlemektedirler. Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn ve yerel te\u015fkil\u00e2t\u0131n, i\u015f hayat\u0131n\u0131n gereklerini ve ihtiya\u00e7lar\u0131n\u0131, konuyla kurulu\u015f kanunlar\u0131 gere\u011fi asl\u00ee olarak ilgilenen kurumlar kadar bilmesi ve bu alanda etkili olmas\u0131 beklenemez. \u0130\u015fte bu noktada son birka\u00e7 ayda yap\u0131lan mevzuat de\u011fi\u015fiklikleri ile merkezde ve yerel d\u00fczeyde olu\u015fturulan kurullar \u00f6nem ta\u015f\u0131maktad\u0131r. Bu \u015fekilde h\u00fck\u00fcml\u00fc ve tutuklular\u0131n tahliye olduktan sonra cezaevi d\u0131\u015f\u0131ndaki ya\u015famlar\u0131n\u0131 etkileyen kurumlar\u0131n desteklerinin artarak sa\u011flanmas\u0131 m\u00fcmk\u00fcn olacakt\u0131r. \u015eimdiye kadar gerek resm\u00ee ve gerekse \u00f6zel kurumlar aras\u0131ndaki yard\u0131mla\u015fman\u0131n ger\u00e7ekle\u015ftirilmesi yap\u0131lan protokollerle bir \u00f6l\u00e7\u00fcde sa\u011flanmaya \u00e7al\u0131\u015f\u0131lm\u0131\u015ft\u0131. T\u00fcrkiye \u0130\u015f Kurumu, Mill\u00ee E\u011fitim Bakanl\u0131\u011f\u0131, Gen\u00e7lik ve Spor Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile yap\u0131lan i\u015f birli\u011fi protokolleri bu \u00e7al\u0131\u015fmalar\u0131n g\u00fczel \u00f6rneklerinden birka\u00e7 tanesidir. Ancak getirilen yeni d\u00fczenlemelerle olu\u015fturulan kurullar bu i\u015f birli\u011fi s\u00fcrecinin \u00f6zellikle yerel d\u00fczeyde kurumsalla\u015fmas\u0131 a\u00e7\u0131s\u0131ndan \u00e7ok yararl\u0131 olacakt\u0131r. Yapt\u0131\u011f\u0131m\u0131z k\u0131sa giri\u015ften de anla\u015f\u0131laca\u011f\u0131 \u00fczere son birka\u00e7 ayda i\u015f mevzuat\u0131nda yap\u0131lan de\u011fi\u015fiklikleri konu alan bu yaz\u0131 dizisinin \u00fc\u00e7 temel amac\u0131 vard\u0131r: 1- Mevzuata yeni giren ve cezaevlerini ilgilendiren kavram ve kurumlar\u0131n a\u00e7\u0131klanarak tan\u0131t\u0131lmas\u0131, 2- Olu\u015fturulan kurullardan kurumlar\u0131m\u0131z\u0131n olabildi\u011fince yararlanabilmesi i\u00e7in ne t\u00fcr \u00e7al\u0131\u015fmalar yap\u0131labilece\u011fi konusunda uygulamac\u0131lara fikir verilmesi, 3- Kurumlar\u0131m\u0131z\u0131 ilgilendiren ve de\u011fi\u015ftirilen di\u011fer konularda ilgililerin bilgilendirilmesi, II. T\u00fcrkiye \u0130\u015f Kurumu Kanunu ve \u0130lgili Mevzuat\u0131n\u0131n Etkileri T\u00fcrkiye \u0130\u015f Kurumu Kanunu ile istihdam\u0131n korunmas\u0131na, geli\u015ftirilmesine, yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131na ve i\u015fsizli\u011fin \u00f6nlenmesi faaliyetlerine yard\u0131mc\u0131 olmak ve i\u015fsizlik sigortas\u0131 hizmetlerini y\u00fcr\u00fctmek \u00fczere T\u00fcrkiye \u0130\u015f Kurumu kurulmu\u015ftur (m1, I). Kurum, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131n\u0131n ba\u011fl\u0131 kurulu\u015fu olup, \u00f6zel hukuk h\u00fck\u00fcmlerine t\u00e2bi, t\u00fczel ki\u015fili\u011fi haiz, idar\u00ee ve mal\u00ee bak\u0131mdan \u00f6zerk bir kamu kurulu\u015fudur (m. 1, III). Kanunun 4\u2019\u00fcnc\u00fc maddesine g\u00f6re Kurumun bir organ\u0131 olan Genel Kurulun 5\u2019inci maddede say\u0131lan g\u00f6revlerinden Adalet Bakanl\u0131\u011f\u0131n\u0131 ilgilendiren h\u00fck\u00fcmleri \u015funlard\u0131r: a) Devletin ekonomik ve sosyal politikalar\u0131na uyumlu ulusal istihdam politikas\u0131n\u0131n olu\u015fturulmas\u0131na yard\u0131mc\u0131 olmak, uygulanan politikalarda d\u00f6nem i\u00e7indeki geli\u015fmeleri de\u011ferlendirmek. b) \u0130stihdam\u0131n korunmas\u0131na, geli\u015ftirilmesine, yayg\u0131nla\u015ft\u0131r\u0131lmas\u0131na ve i\u015fsizli\u011fin \u00f6nlenmesi faaliyetlerine yard\u0131mc\u0131 olmak ve \u00f6nerilerde bulunmak. 5\u2019inci maddenin son f\u0131kras\u0131nda da Genel Kurul kararlar\u0131n\u0131n, Kurum ve di\u011fer ilgili kurum ve kurulu\u015flar\u0131n politika olu\u015fturma ve uygulamalar\u0131nda \u00f6ncelikle dikkate al\u0131naca\u011f\u0131 belirtilmi\u015ftir. Genel Kurulda Adalet Bakanl\u0131\u011f\u0131n\u0131n da Genel M\u00fcd\u00fcr d\u00fczeyinde temsil edilece\u011fi \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. Dolay\u0131s\u0131yla \u00dclkenin istihdam politikas\u0131 belirlenirken eski h\u00fck\u00fcml\u00fclerin haklar\u0131n\u0131n korunmas\u0131, tan\u0131t\u0131lmas\u0131 ve geli\u015ftirilmesi amac\u0131yla T\u00fcrkiye \u0130\u015f Kurumu Genel Kurulu \u00f6nemli bir platform olarak kullan\u0131labilir. Merkezde olu\u015fturulan ve iki y\u0131lda bir toplanmas\u0131 \u00f6ng\u00f6r\u00fclen Genel Kurulun yan\u0131 s\u0131ra yerel d\u00fczeyde de kat\u0131l\u0131m\u0131 sa\u011flamak i\u00e7in y\u0131lda bir defa toplanmas\u0131 \u00f6ng\u00f6r\u00fclen ve T\u00fcrkiye \u0130\u015f Kurumunun bir organ\u0131 olan \u0130l \u0130stihdam Kurullar\u0131 olu\u015fturulmu\u015ftur (m 13). Ge\u00e7en say\u0131da, kurumlar\u0131m\u0131zda verilen e\u011fitimin mutlaka tahliye sonras\u0131 ile ba\u011flant\u0131 kurularak d\u00fczenlenmesi gerekti\u011fini, bu nedenle Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcm\u00fcz d\u0131\u015f\u0131ndaki kurum ve kurulu\u015flarla yak\u0131n bir i\u015f birli\u011finin kurulmas\u0131n\u0131n \u00f6nemli oldu\u011funu, i\u015f mevzuat\u0131ndaki de\u011fi\u015fikliklerle olu\u015fturulan kurullar\u0131n \u00f6zellikle yerel d\u00fczeydeki e\u015fg\u00fcd\u00fcm\u00fcn kurumsalla\u015fmas\u0131 ve yayg\u0131nla\u015fmas\u0131 a\u00e7\u0131s\u0131ndan yararl\u0131 olaca\u011f\u0131n\u0131 vurgulayarak, T\u00fcrkiye \u0130\u015f Kurumunun bir organ\u0131 olan Genel Kurulun g\u00f6revleri ve eski h\u00fck\u00fcml\u00fc istihdam\u0131na katk\u0131lar\u0131 konusunda a\u00e7\u0131klamalarda bulunmu\u015ftum. Bu say\u0131da ise, yaz\u0131m\u0131n giri\u015f b\u00f6l\u00fcm\u00fcnde k\u0131saca de\u011findi\u011fim \u0130l \u0130stihdam Kurullar\u0131 \u00fczerine a\u00e7\u0131klamalarda bulunarak 4857 say\u0131l\u0131 \u0130\u015f Kanununun \u00f6ng\u00f6rd\u00fc\u011f\u00fc yeni sistem ile ilgili bilgiler vermeye \u00e7al\u0131\u015faca\u011f\u0131m. \u0130l \u0130stihdam Kurullar\u0131, illerde valinin ba\u015fkanl\u0131\u011f\u0131nda, belediye ba\u015fkan\u0131, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 B\u00f6lge M\u00fcd\u00fcrl\u00fc\u011f\u00fc bulunan yerlerde b\u00f6lge m\u00fcd\u00fcr\u00fc, il mill\u00ee e\u011fitim m\u00fcd\u00fcr\u00fc, Sosyal Hizmetler ve \u00c7ocuk Esirgeme Kurumu il m\u00fcd\u00fcr\u00fc, Gen\u00e7lik ve Spor il m\u00fcd\u00fcr\u00fc, Sanayi ve Ticaret Bakanl\u0131\u011f\u0131 il m\u00fcd\u00fcr\u00fc, T\u00fcrkiye \u0130\u015f Kurumu il m\u00fcd\u00fcr\u00fc ve il\u00e7e \u015fube m\u00fcd\u00fcrleri, \u0130l Ticaret ve\/veya Sanayi Odas\u0131 Ba\u015fkanlar\u0131, \u0130l Esnaf ve Sanatk\u00e2rlar Odalar\u0131 Birli\u011fi ba\u015fkan\u0131, \u0130l K\u00fc\u00e7\u00fck ve Orta \u00d6l\u00e7ekli Sanayi Geli\u015ftirme ve Destekleme \u0130daresi ba\u015fkan\u0131, il organize sanayi b\u00f6lgeleri m\u00fcd\u00fcrleri, ilde bulunan fak\u00fclte veya y\u00fcksek okullardan belirlenecek en fazla \u00fc\u00e7 \u00f6\u011fretim \u00fcyesi, T\u00fcrkiye Sakatlar Konfederasyonu taraf\u0131ndan belirlenecek bir temsilci, il mahalle ve k\u00f6y muhtarlar\u0131ndan birer temsilci, valinin ilin istihdam yap\u0131s\u0131n\u0131 dikkate alarak davet edece\u011fi e\u011fitim kurumlar\u0131, sivil toplum \u00f6rg\u00fctleri ile di\u011fer kurum ve kurulu\u015f temsilcileri ve o ilde en \u00e7ok \u00fcyeye sahip i\u015f\u00e7i ve i\u015fveren konfederasyonlar\u0131n\u0131n birer temsilcisinden olu\u015fur (m. 13,I). G\u00f6r\u00fcld\u00fc\u011f\u00fc \u00fczere T\u00fcrkiye \u0130\u015f Kurumunun yerel bir organ\u0131 olan \u0130l \u0130stihdam Kurulu istihdamla ilgili her kesimin temsil edilebildi\u011fi bir meclis g\u00f6r\u00fcn\u00fcm\u00fcndedir. Kanunda a\u00e7\u0131k\u00e7a bu Kurula Cumhuriyet ba\u015fsavc\u0131s\u0131 ve cezaevi 1\u2019nci m\u00fcd\u00fcr\u00fcn\u00fcn kat\u0131laca\u011f\u0131 belirtilmemi\u015f olmas\u0131na ra\u011fmen, maddede ge\u00e7en \u201cdi\u011fer kurum ve kurulu\u015f temsilcileri\u201d kapsam\u0131nda bu ki\u015filerin kat\u0131l\u0131mlar\u0131n\u0131n sa\u011flanmas\u0131 T\u00fcrkiye \u0130\u015f Kurumu Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcyle var\u0131lan mutabakat sonucunda kabul edilerek, 19.9.2003 tarih ve 61287 say\u0131l\u0131 genelge ile yerel te\u015fkil\u00e2t\u0131m\u0131za duyurulmu\u015ftur. \u00dclke genelinde eski h\u00fck\u00fcml\u00fc istihdam politikas\u0131 olu\u015fturulmas\u0131 ve projeler haz\u0131rlanabilmesi i\u00e7in Cumhuriyet ba\u015fsavc\u0131l\u0131klar\u0131m\u0131zdan gelen \u0130l \u0130stihdam Kurulu toplant\u0131 karar tutanaklar\u0131 Tahliye Sonras\u0131 Koruma \u015eube M\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan de\u011ferlendirilerek, Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcm\u00fcz\u00fcn eski h\u00fck\u00fcml\u00fc istihdam\u0131na ili\u015fkin \u00e7al\u0131\u015fmalar\u0131na katk\u0131 sa\u011flamaktad\u0131r. \u0130l \u0130stihdam Kurullar\u0131 her y\u0131l Eyl\u00fcl ay\u0131 i\u00e7inde ola\u011fan toplant\u0131s\u0131n\u0131 yapar. Ba\u015fkan\u0131n \u00e7a\u011fr\u0131s\u0131 \u00fczerine de her zaman ola\u011fan\u00fcst\u00fc toplant\u0131 yapabilir. Kurulun sekreterya g\u00f6revini T\u00fcrkiye \u0130\u015f Kurumu il m\u00fcd\u00fcrl\u00fckleri yerine getirir. \u0130l \u0130stihdam Kurullar\u0131n\u0131n g\u00f6revleri \u015funlard\u0131r: a) \u0130l d\u00fczeyinde istihdam\u0131 koruyucu, geli\u015ftirici ve i\u015fsizli\u011fi \u00f6nleyici tedbirleri saptamak, b) \u0130l istihdam politikas\u0131n\u0131n olu\u015fturulmas\u0131na yard\u0131mc\u0131 olmak, i\u015f g\u00fcc\u00fc yeti\u015ftirme etkinliklerini y\u00f6nlendirmek \u00fczere yerel d\u00fczeyde ge\u00e7erli olacak ilke ve politikalar\u0131 belirlemek, c) Kurum il m\u00fcd\u00fcrl\u00fc\u011f\u00fc taraf\u0131ndan haz\u0131rlanan y\u0131ll\u0131k i\u015f g\u00fcc\u00fc e\u011fitim pl\u00e2nlar\u0131n\u0131 inceleyerek varsa gerekli de\u011fi\u015fiklikleri yapmak, d) E\u011fitim pl\u00e2n\u0131 uygulamas\u0131 ile ilgili olarak y\u00f6redeki i\u015f g\u00fcc\u00fc yeti\u015ftirme ve istihdam etkinliklerini izleyip de\u011ferlendirmek. \u0130l \u0130stihdam Kurullar\u0131n\u0131n g\u00f6revleri incelendi\u011finde, h\u00fck\u00fcml\u00fc ve tutuklular\u0131n, hem e\u011fitimlerinde hem de tahliye sonras\u0131 i\u015fe yerle\u015ftirilmelerinde \u00e7ok \u00f6nemli i\u015flevleri oldu\u011fu g\u00f6r\u00fclmektedir. Bu durumun fark\u0131nda olan Cumhuriyet ba\u015fsavc\u0131lar\u0131m\u0131z ve cezaevi 1\u2019inci m\u00fcd\u00fcrlerimizin \u00e7o\u011fu Kuruldaki toplant\u0131larda h\u00fck\u00fcml\u00fc ve tutuklu e\u011fitimi ile eski h\u00fck\u00fcml\u00fc istihdam\u0131na ili\u015fkin \u00f6nemli kararlar\u0131n al\u0131nmas\u0131n\u0131 sa\u011flam\u0131\u015flard\u0131r. Bu \u015fekilde, toplumun cezaevlerine ve eski h\u00fck\u00fcml\u00fclere kar\u015f\u0131 olan bak\u0131\u015f a\u00e7\u0131s\u0131n\u0131n daha olumlu bir h\u00e2le getirilmesi ve h\u00fck\u00fcml\u00fclerin topluma kazand\u0131r\u0131lmas\u0131 i\u00e7in \u0130l \u0130stihdam Kurullar\u0131, cezaevi y\u00f6netimleri taraf\u0131ndan \u00f6nemli bir platform olarak kullan\u0131lmaya ba\u015flanm\u0131\u015ft\u0131r.<\/p>\n<p>III. \u0130\u015e KANUNU VE \u0130LG\u0130L\u0130 MEVZUATININ ETK\u0130LER\u0130<\/p>\n<p>26.5.2003 tarihinde TBMM\u2019ce kabul edilerek 10.6.2003 tarihinde y\u00fcr\u00fcrl\u00fc\u011fe giren 4857 say\u0131l\u0131 \u0130\u015f Kanunu ile eski h\u00fck\u00fcml\u00fclerin istihdam\u0131na ili\u015fkin 1475 say\u0131l\u0131 \u0130\u015f Kanunundaki sistemden farkl\u0131 bir d\u00fczenleme \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr. \u0130\u015f Kanununun 30\u2019uncu maddesinin 1\u2019inci f\u0131kras\u0131na g\u00f6re, \u201c\u0130\u015fverenler elli veya daha fazla i\u015f\u00e7i \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 i\u015f yerlerinde her y\u0131l\u0131n Ocak ay\u0131 ba\u015f\u0131ndan itibaren y\u00fcr\u00fcrl\u00fc\u011fe girecek \u015fekilde Bakanlar Kurulunca belirlenecek oranlarda \u00f6z\u00fcrl\u00fc ve eski h\u00fck\u00fcml\u00fc ile 3713 say\u0131l\u0131 Ter\u00f6rle M\u00fccadele Kanununun ek 1\u2019inci maddesinin (B) f\u0131kras\u0131 uyar\u0131nca istihdam\u0131 zorunlu olan ter\u00f6r ma\u011fduru i\u015f\u00e7iyi meslek, beden ve ruh\u00ee durumlar\u0131na uygun i\u015flerde \u00e7al\u0131\u015ft\u0131rmakla y\u00fck\u00fcml\u00fcd\u00fcrler. Bu kapsamda \u00e7al\u0131\u015ft\u0131r\u0131lacak i\u015f\u00e7ilerin toplam oran\u0131 y\u00fczde alt\u0131d\u0131r.\u201d 1475 say\u0131l\u0131 \u0130\u015f Kanunu ile \u00f6ng\u00f6r\u00fclen ve yasal teminat alt\u0131na al\u0131nan % 2\u2019lik oran yerine, her y\u0131l Bakanlar Kurulu taraf\u0131ndan i\u015f yerlerinde \u00e7al\u0131\u015ft\u0131r\u0131lacak eski h\u00fck\u00fcml\u00fc oran\u0131n\u0131n belirlenmesi y\u00f6ntemi benimsenmi\u015ftir. Ancak \u00f6z\u00fcrl\u00fcler i\u00e7in belirlenecek olan oran % 3\u2019ten a\u015fa\u011f\u0131 olamaz. Bakanlar Kurulunca belirlenecek oranlar\u0131n \u00fcst\u00fcnde eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131ran i\u015fverenlerin, \u00e7al\u0131\u015ft\u0131rd\u0131klar\u0131 her bir eski h\u00fck\u00fcml\u00fc i\u00e7in 506 say\u0131l\u0131 Sosyal Sigortalar Kanununa g\u00f6re \u00f6demeleri gereken i\u015fveren sigorta prim hisselerinin y\u00fczde ellisini kendisi, y\u00fczde ellisini Hazine \u00f6der (m. 30, IX). Bu \u015fekilde kontenjan fazlas\u0131 eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131ran i\u015fverenlerin \u00f6dedikleri sigorta primlerinin yar\u0131s\u0131 Hazine taraf\u0131ndan \u00f6denerek i\u015f yerleri eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmaya te\u015fvik edilmi\u015ftir. Ge\u00e7en iki say\u0131da, kurumlar\u0131m\u0131zda verilen e\u011fitimin mutlaka tahliye sonras\u0131 ile ba\u011flant\u0131 kurularak d\u00fczenlenmesi gerekti\u011fini, i\u015f mevzuat\u0131ndaki de\u011fi\u015fikliklerle olu\u015fturulan kurullar\u0131n \u00f6zellikle yerel d\u00fczeydeki e\u015fg\u00fcd\u00fcm\u00fcn kurumsalla\u015fmas\u0131 ve yayg\u0131nla\u015fmas\u0131 a\u00e7\u0131s\u0131ndan yararl\u0131 olaca\u011f\u0131n\u0131 vurgulayarak, T\u00fcrkiye \u0130\u015f Kurumunun organlar\u0131 olan Genel Kurulun ve \u0130l \u0130stihdam Kurullar\u0131n\u0131n g\u00f6revleriyle ilgili a\u00e7\u0131klamalarda bulunarak, \u201c\u0130\u015f Kanunu ve \u0130lgili Mevzuat\u0131\u201d konusuna k\u0131sa bir giri\u015f yapm\u0131\u015ft\u0131m. Bu say\u0131da ise, ge\u00e7en say\u0131da k\u0131saca de\u011findi\u011fim \u201c\u0130\u015f Kanunu ve \u0130lgili Mevzuat\u0131\u201d ile getirilen d\u00fczenlemeler hakk\u0131nda bilgi vermeye \u00e7al\u0131\u015faca\u011f\u0131m. A. 4857 say\u0131l\u0131 \u0130\u015f Kanununa G\u00f6re \u00c7\u0131kar\u0131lan Y\u00f6netmeliklerle Eski H\u00fck\u00fcml\u00fclerin \u0130stihdam\u0131 Hakk\u0131nda T\u00fcz\u00fck Aras\u0131ndaki \u0130li\u015fki 4857 say\u0131l\u0131 \u0130\u015f Kanununun 119\u2019uncu maddesine g\u00f6re, \u201cBu Kanunda \u00f6ng\u00f6r\u00fclen y\u00f6netmelikler Kanunun yay\u0131m\u0131 tarihinden itibaren alt\u0131 ay i\u00e7erisinde \u00e7\u0131kart\u0131l\u0131r.\u201d Kanunun ge\u00e7ici 2\u2019nci maddesinde ise, 1475 say\u0131l\u0131 Kanuna g\u00f6re h\u00e2len y\u00fcr\u00fcrl\u00fckte bulunan t\u00fcz\u00fck ve y\u00f6netmeliklerin bu Kanun h\u00fck\u00fcmlerine ayk\u0131r\u0131 olmayan h\u00fck\u00fcmlerinin, yeni y\u00f6netmelikler \u00e7\u0131kar\u0131l\u0131ncaya kadar y\u00fcr\u00fcrl\u00fckte kalaca\u011f\u0131 belirtilmi\u015ftir. Dolas\u0131yla eski h\u00fck\u00fcml\u00fclerin istihdam\u0131 konusu incelenirken, hem yeni \u00e7\u0131kan y\u00f6netmeliklerin hem de hen\u00fcz y\u00f6netmelikle d\u00fczenlenmemi\u015f konularda \u201cEski H\u00fck\u00fcml\u00fclerin \u0130stihdam\u0131 Hakk\u0131nda T\u00fcz\u00fck\u201d h\u00fck\u00fcmlerinin dikkate al\u0131nmas\u0131 gerekmektedir. Bu noktada y\u00f6netmelik h\u00fck\u00fcmlerinin normlar hiyerar\u015fisi i\u00e7inde daha \u00fcst bir konumda olan T\u00fcz\u00fck h\u00fck\u00fcmlerini ortadan kald\u0131ramayaca\u011f\u0131 d\u00fc\u015f\u00fcn\u00fclebilirse de Kanunda a\u00e7\u0131k\u00e7a T\u00fcz\u00fck h\u00fck\u00fcmlerinin, yeni y\u00f6netmelikler \u00e7\u0131k\u0131ncaya kadar y\u00fcr\u00fcrl\u00fckte kalacaklar\u0131n\u0131n belirtildi\u011fi dikkate al\u0131nmal\u0131d\u0131r. \u0130\u015f Kanunu ve ilgili mevzuat\u0131 a\u00e7\u0131s\u0131ndan \u201ceski h\u00fck\u00fcml\u00fc\u201d kavram\u0131 \u00e7ok b\u00fcy\u00fck \u00f6nem ta\u015f\u0131maktad\u0131r. 1475 say\u0131l\u0131 \u0130\u015f Kanunu gibi 4857 say\u0131l\u0131 \u0130\u015f Kanunu da bu kavram\u0131 tan\u0131mlamad\u0131\u011f\u0131 i\u00e7in konunun d\u00fczenlenmesi y\u00f6netmeliklere b\u0131rak\u0131lm\u0131\u015ft\u0131r. 26 Eyl\u00fcl 2003 tarih ve 2541 say\u0131l\u0131 Resm\u00ee Gazete\u2019de yay\u0131mlanarak y\u00fcr\u00fcrl\u00fc\u011fe giren \u00d6z\u00fcrl\u00fc Ve Eski H\u00fck\u00fcml\u00fc \u00c7al\u0131\u015ft\u0131rmayan \u0130\u015fverenlerden Kesilen Ceza Paralar\u0131n\u0131 Kullanmaya Yetkili Komisyonun Kurulu\u015fu ile \u00c7al\u0131\u015fma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmeli\u011fin tan\u0131mlar ba\u015fl\u0131kl\u0131 4\u2019\u00fcnc\u00fc maddesine g\u00f6re eski h\u00fck\u00fcml\u00fc: \u201cBu Y\u00f6netmelik kapsam\u0131nda bir y\u0131ldan daha uzun s\u00fcreli \u00f6zg\u00fcrl\u00fc\u011f\u00fc ba\u011flay\u0131c\u0131 bir cezadan veya Devlet memuru olmaya engel su\u00e7tan h\u00fck\u00fcm giyenleri, cezas\u0131n\u0131 infaz kurumunda tamamlayanlar\u0131, cezas\u0131 tecil edilenleri, \u00f6zel kanunlarda belirtilen \u015fartlardan dolay\u0131 istihdam edilme olana\u011f\u0131 bulunmayanlar ile \u00f6m\u00fcr boyu kamu hizmetlerinden yasakl\u0131 bulunanlar\u0131\u201d ifade eder. Bu tan\u0131m, Eski H\u00fck\u00fcml\u00fclerin \u0130stihdam\u0131 Hakk\u0131nda T\u00fcz\u00fck\u2019te belirtilen \u201ceski h\u00fck\u00fcml\u00fc\u201d tan\u0131m\u0131ndan farkl\u0131 olarak ceza s\u00fcresini alt\u0131 aydan bir y\u0131la \u00e7\u0131karm\u0131\u015ft\u0131r. Bunun d\u0131\u015f\u0131nda eski h\u00fck\u00fcml\u00fc tan\u0131m\u0131nda bir de\u011fi\u015fiklik yap\u0131lmad\u0131\u011f\u0131 i\u00e7in konuyu a\u00e7\u0131klamak amac\u0131yla \u00e7\u0131kar\u0131lan 22.2.1999 tarih ve TSK\/9-33 say\u0131l\u0131 Genelgedeki bilgilerden faydalan\u0131labilir. Eski h\u00fck\u00fcml\u00fclerin nitelikleri, \u00e7al\u0131\u015ft\u0131r\u0131labilecekleri i\u015fler, genel h\u00fck\u00fcmler d\u0131\u015f\u0131nda ba\u011fl\u0131 olacaklar\u0131 \u00f6zel \u015fartlar, \u00fccret \u015fartlar\u0131 ve bunlar\u0131n i\u015fverenlerce i\u015fe al\u0131nma usul ve esaslar\u0131 konusunda hen\u00fcz bir y\u00f6netmelik \u00e7\u0131kar\u0131lmad\u0131\u011f\u0131 i\u00e7in, bu konular\u0131 d\u00fczenleyen Eski H\u00fck\u00fcml\u00fclerin \u0130stihdam\u0131 Hakk\u0131nda T\u00fcz\u00fck\u2019\u00fcn 4857 say\u0131l\u0131 \u0130\u015f Kanununa ayk\u0131r\u0131 olmayan h\u00fck\u00fcmleri \u015fu an i\u00e7in y\u00fcr\u00fcrl\u00fcktedir. B. \u00d6z\u00fcrl\u00fc Ve Eski H\u00fck\u00fcml\u00fc \u00c7al\u0131\u015ft\u0131rmayan \u0130\u015fverenlerden Kesilen Ceza Paralar\u0131n\u0131 Kullanmaya Yetkili Komisyonun Kurulu\u015fu ile \u00c7al\u0131\u015fma Usul ve Esaslar\u0131 Hakk\u0131nda Y\u00f6netmelik 4857 say\u0131l\u0131 \u0130\u015f Kanununun 30\u2019uncu maddesinin son f\u0131kras\u0131na g\u00f6re, \u201c101\u2019inci madde uyar\u0131nca tahsil edilecek para cezalar\u0131 T\u00fcrkiye \u0130\u015f Kurumu b\u00fct\u00e7esinin Maliye Bakanl\u0131\u011f\u0131nca a\u00e7\u0131lacak \u00f6zel tertibine gelir kaydedilir. Bu hesapta toplanan paralar \u00f6z\u00fcrl\u00fc ve eski h\u00fck\u00fcml\u00fclerin meslek\u00ee rehabilitasyonu, kendi i\u015fini kurma ve bu gibi projelerde kullan\u0131lmak \u00fczere T\u00fcrkiye \u0130\u015f Kurumuna aktar\u0131l\u0131r. Toplanan paralar\u0131n nerelere ve ne kadar verilece\u011fi T\u00fcrkiye \u0130\u015f Kurumu Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn\u00fcn koordinat\u00f6rl\u00fc\u011f\u00fcnde, \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131 \u00c7al\u0131\u015fma Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, \u0130\u015f Sa\u011fl\u0131\u011f\u0131 ve G\u00fcvenli\u011fi Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, \u00d6z\u00fcrl\u00fcler \u0130daresi Ba\u015fkanl\u0131\u011f\u0131, Adalet Bakanl\u0131\u011f\u0131 Ceza ve Tevkifevleri Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fc, T\u00fcrkiye Sakatlar Konfederasyonu ve en \u00e7ok i\u015f\u00e7i ve i\u015fvereni temsil eden \u00fcst kurulu\u015flar\u0131n birer temsilcisinden olu\u015fan komisyon taraf\u0131ndan karara ba\u011flan\u0131r. Komisyonun \u00e7al\u0131\u015fma usul ve esaslar\u0131 \u00c7al\u0131\u015fma ve Sosyal G\u00fcvenlik Bakanl\u0131\u011f\u0131nca \u00e7\u0131kar\u0131lacak y\u00f6netmelikle d\u00fczenlenir.\u201d Yukar\u0131da a\u00e7\u0131klad\u0131\u011f\u0131m\u0131z ama\u00e7la \u00e7\u0131kar\u0131lan bu Y\u00f6netmelik, \u00f6z\u00fcrl\u00fc ve eski h\u00fck\u00fcml\u00fc \u00e7al\u0131\u015ft\u0131rmayan i\u015fverenlerden veya i\u015fveren vekillerinden 4857 say\u0131l\u0131 \u0130\u015f Kanununun 101\u2019inci maddesi uyar\u0131nca kesilip T\u00fcrkiye \u0130\u015f Kurumu b\u00fct\u00e7esinin Maliye Bakanl\u0131\u011f\u0131nca a\u00e7\u0131lacak \u00f6zel tertibine gelir olarak kaydedilecek para cezalar\u0131n\u0131n kullan\u0131m\u0131 hakk\u0131nda karar vermeye yetkili komisyonun \u00e7al\u0131\u015fma usul ve esaslar\u0131n\u0131 d\u00fczenlemektedir. Y\u00f6netmeli\u011fin 6\u2019nc\u0131 maddesinin 2\u2019nci f\u0131kras\u0131na g\u00f6re, \u201cKomisyon uygulanmas\u0131 \u00f6nerilen projeleri; ama\u00e7, ger\u00e7ekle\u015ftirme s\u00fcresi, &#8230; eski h\u00fck\u00fcml\u00fc say\u0131lar\u0131,&#8230; istihdama katk\u0131s\u0131 bak\u0131m\u0131ndan inceler, mevcut para miktar\u0131n\u0131 da dikkate alarak de\u011ferlendirir. \u0130stihdam garantisi verilen proje \u00f6nerileri tercih edilir.\u201d Komisyon 31 Ekim 2003 tarihinde yapt\u0131\u011f\u0131 ilk toplant\u0131s\u0131nda Y\u00f6netmelikte belirtilen \u00f6l\u00e7\u00fctlere ek olarak \u201ch\u00fck\u00fcml\u00fclerin meslek e\u011fitimi ve meslek\u00ee rehabilitasyonu konular\u0131ndaki projelerin, \u00f6zellikle tahliye sonras\u0131 istihdamlar\u0131na katk\u0131 sa\u011flamas\u0131, birden fazla kurum ve kurulu\u015fla i\u015f birli\u011fi yap\u0131lmas\u0131, uluslararas\u0131 fonlardan madd\u00ee destek almaya elveri\u015fli olmas\u0131 gibi \u00f6zelliklerinin bulunmas\u0131\u201dn\u0131 tercih sebebi olarak kararla\u015ft\u0131rm\u0131\u015ft\u0131r. Dolay\u0131s\u0131yla kurumlar\u0131m\u0131z\u0131n bu fondan yararlanmalar\u0131 i\u00e7in belirtilen k\u0131staslara uygun projeler \u00fcretmeleri gerekmektedir. Bu konuda ihtiya\u00e7 duyulmas\u0131 h\u00e2linde Genel M\u00fcd\u00fcrl\u00fc\u011f\u00fcn Tahliye Sonras\u0131 Koruma \u015eube M\u00fcd\u00fcrl\u00fc\u011f\u00fc ile irtibata ge\u00e7ilerek katk\u0131 istenmesi de m\u00fcmk\u00fcn olabilir. Tek kelimeyle ifade etmek gerekirse, \u201ctahliye sonras\u0131\u201d hepimiz i\u00e7in \u201cvizyon\u201ddur. Bu nedenle hem merkez te\u015fkil\u00e2t\u0131n hem de yerel te\u015fkil\u00e2t\u0131n her kademesinde g\u00f6rev yapan personel ile h\u00fck\u00fcml\u00fc ve tutuklular\u0131n bu vizyon \u00e7er\u00e7evesinde d\u00fc\u015f\u00fcnmeleri, davranmalar\u0131 ve kendilerini s\u00fcrekli geli\u015ftirmeleri gereklidir. Bunun i\u00e7in de \u00f6ncelikle konuyla ilgilenen herkeste \u201ctahliye sonras\u0131 koruma ortak bilinci\u201d olu\u015fmal\u0131d\u0131r. Bu \u00e7er\u00e7evede, cezaevinde yap\u0131lan b\u00fct\u00fcn \u00e7al\u0131\u015fmalar\u0131n en temel ve niha\u00ee hedefi tahliye sonras\u0131nda h\u00fck\u00fcml\u00fclerin topluma kazand\u0131r\u0131lmas\u0131d\u0131r. Tahliye sonras\u0131nda h\u00fck\u00fcml\u00fcn\u00fcn topluma ba\u015far\u0131l\u0131 \u015fekilde d\u00f6n\u00fc\u015f\u00fc, toplumla b\u00fct\u00fcnle\u015fmesi, yeniden su\u00e7 i\u015flememesi, kendisine, ailesine ve \u00e7evresine yararl\u0131 olmas\u0131, cezaevlerinin var olu\u015f sebeplerinden en \u00f6nemlisidir.
