Ayr\u0131ca h\u00fck\u00fcml\u00fc ve tutuklular ile cezaevi personelinin e\u011fitimine ili\u015fkin d\u00fc\u015f\u00fcncelerime temel olmak \u00fczere, Avrupa Birli\u011fi Komisyonunun yukar\u0131da belirtti\u011fim \u201c\u00e7al\u0131\u015fma belgesi\u201d \u00e7er\u00e7evesinde e\u011fitim, y\u00f6ntem ve sistemleriyle ilgili konulara de\u011finerek, bu Rapor\u2019un e\u011fitim s\u00fcrecinin ki\u015fi merkezli olmas\u0131 gerekti\u011fi \u015feklindeki ilerici ve etkin e\u011fitim ve \u00f6\u011fretimin temel bir prensibini do\u011frulad\u0131\u011f\u0131n\u0131 belirtmi\u015ftim. Personel ile h\u00fck\u00fcml\u00fc ve tutuklu e\u011fitimine bu \u00e7al\u0131\u015fma belgesinde ileri s\u00fcr\u00fclen d\u00fc\u015f\u00fcncelerin nas\u0131l uygulanabilece\u011fine, \u201cAvrupa Birli\u011fi Komisyonunun Ya\u015fam Boyu \u00d6\u011frenim \u00dczerine Memorandum\u201du ve \u201cYeti\u015fkin E\u011fitimi i\u00e7in Avrupa Te\u015fkil\u00e2t\u0131\u2019n\u0131n Avrupa Birli\u011fi Komisyonunun Ya\u015fam Boyu \u00d6\u011frenime \u0130li\u015fkin Memorandumuna Yan\u0131t\u201d isimli \u00e7al\u0131\u015fmas\u0131ndan yararlanarak k\u0131saca de\u011finmi\u015ftim. Bu say\u0131da ise, ge\u00e7en say\u0131da yan\u0131tlanmas\u0131 gerekti\u011fini belirtti\u011fim, \u201ce\u011fitim ve iyile\u015ftirme faaliyetleri ile kurum d\u00fczeni ve g\u00fcvenli\u011fi aras\u0131nda adil bir dengenin nas\u0131l kurulabilece\u011fi\u201d sorusu \u00fczerine a\u00e7\u0131klamalarda bulunaca\u011f\u0131m.<br \/>\n1990 y\u0131l\u0131nda \u0130ngiliz cezaevlerinde ya\u015fanan bir dizi cidd\u00ee isyandan sonra Lord Justice Wolf taraf\u0131ndan haz\u0131rlanan ara\u015ft\u0131rma raporunda; etkili cezaevi y\u00f6netiminin anahtar\u0131n\u0131n g\u00fcvenlik, kontrol ve adaletin uygun bir dengesinin kurumda s\u00fcrekli h\u00e2kim k\u0131l\u0131nmas\u0131 oldu\u011fu belirtilmi\u015ftir.1 Bu rapora g\u00f6re g\u00fcvenlik, mahpuslar\u0131n ka\u00e7mas\u0131n\u0131n \u00f6nlenmesini; kontrol, kurum d\u00fczeninin mahpuslar taraf\u0131ndan bozulmas\u0131n\u0131n engellenmesini; adelet ise, mahpuslara adil ve insanca muamele edilerek tahliye sonras\u0131nda topluma d\u00f6n\u00fc\u015flerini haz\u0131rlamay\u0131 ifade eder. Biz kavramsal a\u00e7\u0131dan anla\u015f\u0131lmay\u0131 kolayla\u015ft\u0131rmak i\u00e7in \u201cadalet\u201d s\u00f6zc\u00fc\u011f\u00fcn\u00fc sadece \u201cmahpuslara adil ve insanca davran\u0131lmas\u0131\u201d anlam\u0131nda kullanmay\u0131; en geni\u015f manada \u201cmahpuslar\u0131n tahliye sonras\u0131 topluma d\u00f6n\u00fc\u015flerini haz\u0131rlama\u201d anlam\u0131na gelmek ve \u201ctretman2\u201d s\u00f6zc\u00fc\u011f\u00fcn\u00fc kar\u015f\u0131lamak \u00fczere ise \u201ce\u011fitim ve iyile\u015ftirme\u201d kavram\u0131n\u0131 kullanmay\u0131 tercih edece\u011fiz. Bu kavramsal \u00e7er\u00e7eve i\u00e7inde etkili cezaevi y\u00f6netiminin anahtar\u0131n\u0131n; \u201cg\u00fcvenlik, kontrol, adalet ile e\u011fitim ve iyile\u015ftirme faaliyetlerinin uygun bir dengesinin kurumda s\u00fcrekli h\u00e2kim k\u0131l\u0131nmas\u0131\u201d oldu\u011fu s\u00f6ylenebilir.<br \/>\nMahpuslara adil ve insanca muamele edilmesinin \u201cg\u00fcvenlik\u201d ve \u201ckontrol\u201d\u00fc zaafa u\u011frataca\u011f\u0131 d\u00fc\u015f\u00fcncesinin aksine, kurumda \u201cg\u00fcvenlik\u201d ve \u201ckontrol\u201d\u00fc sa\u011flaman\u0131n en iyi yolu onlara adil ve insanca davranarak uygun ve d\u00fczenli bir ortam sa\u011flamakt\u0131r. Personel ve mahpuslar i\u00e7in g\u00fcvenli olmas\u0131, herkese e\u015fit ve adil davran\u0131ld\u0131\u011f\u0131na ili\u015fkin genel bir inanc\u0131n bulunmas\u0131 ve kendilerini geli\u015ftirici aktivitelere kat\u0131larak tahliye sonras\u0131na haz\u0131rlanmalar\u0131 i\u00e7in mahpuslara olanak tan\u0131nmas\u0131, kurumda uygun ve d\u00fczenli bir ortam\u0131n bulundu\u011funun g\u00f6stergeleridir. Dolay\u0131s\u0131yla e\u011fitim ve iyile\u015ftirme \u00e7al\u0131\u015fmalar\u0131, mahpuslara yap\u0131lan bir l\u00fctuf de\u011fil, ideal bir cezaevi ortam\u0131n\u0131n temel bir unsurudur.<br \/>\n\u201cG\u00fcvenlik\u201d, \u201ckontrol\u201d, \u201cadalet\u201d ile \u201ce\u011fitim ve iyile\u015ftirme\u201d faaliyetlerinin dengeli bir \u015fekilde s\u00fcrd\u00fcr\u00fcld\u00fc\u011f\u00fc uygun bir kurum ya\u015fant\u0131s\u0131n\u0131 destekleyen ve bunlar kadar \u00f6nemli olan bir unsur da mahpuslar\u0131n d\u0131\u015f d\u00fcnya ile ili\u015fkilerinin d\u00fczenli bir bi\u00e7imde y\u00fcr\u00fct\u00fclmesidir. Mahpuslar\u0131n ziyaret\u00e7ileri ile g\u00f6r\u00fc\u015fmeleri de dahil olmak \u00fczere, telefon, mektup, kitap, gazete, dergi, televizyon, radyo gibi ileti\u015fim ara\u00e7lar\u0131 sayesinde d\u0131\u015f d\u00fcnya ile ili\u015fkilerini g\u00fc\u00e7lendirmenin, \u201cg\u00fcvenlik\u201d ve \u201ckontrol\u201d\u00fc zaafa u\u011frataca\u011f\u0131 d\u00fc\u015f\u00fcncesinin aksine, g\u00fcvenli ve kontroll\u00fc bir kurum ya\u015fant\u0131s\u0131n\u0131 olumlu \u015fekilde etkileyece\u011fi unutulmamal\u0131d\u0131r. Mahpuslara e\u015fit ve insanca davran\u0131larak onlar\u0131n topluma yeniden kazand\u0131r\u0131lmas\u0131 amac\u0131yla tahliye sonras\u0131na haz\u0131rlanmalar\u0131n\u0131 ifade etmek i\u00e7in kulland\u0131\u011f\u0131m\u0131z \u201cadalet\u201d ile \u201ce\u011fitim ve iyile\u015ftirme\u201d kavramlar\u0131n\u0131n tamamlay\u0131c\u0131s\u0131 olarak, onlar\u0131n d\u0131\u015f d\u00fcnya ile ili\u015fkilerini g\u00fc\u00e7lendirmek, e\u011fitim programlar\u0131n\u0131n ve psiko-sosyal programlar\u0131n hem bireysel hem de toplumsal anlamda yararlar\u0131n\u0131 artt\u0131ran \u00f6nemli bir ara\u00e7t\u0131r. Niha\u00ee hedef tahliyelerinden sonra topluma uyumlar\u0131n\u0131 sa\u011flamak oldu\u011funa g\u00f6re, hen\u00fcz kurumda iken d\u0131\u015f d\u00fcnya ile ili\u015fkilerine olabildi\u011fince imk\u00e2n tan\u0131yarak mahpuslara \u00f6zg\u00fcr kalacaklar\u0131 g\u00fcne ili\u015fkin bir bak\u0131\u015f a\u00e7\u0131s\u0131 sunmak, onlar\u0131n hayat damarlar\u0131n\u0131n canl\u0131 tutulmas\u0131 ile ayn\u0131 gelmektedir. Her t\u00fcrl\u00fc s\u0131k\u0131nt\u0131lara kar\u015f\u0131 y\u0131lmadan hayata olumlu \u015fekilde bakmay\u0131 becerebilen, tahliye sonras\u0131nda kendine yeni bir d\u00fcnya kurmay\u0131 d\u00fc\u015f\u00fcnebilen ve buna inanan mahpus say\u0131s\u0131n\u0131n artmas\u0131; hem kendisine, hem de personel de dahil olmak \u00fczere kurumun di\u011fer sakinlerine zarar verme riski olan mahpus say\u0131s\u0131n\u0131n azalmas\u0131 ve sonu\u00e7 olarak, \u201cg\u00fcvenlik\u201d, \u201ckontrol\u201d, \u201cadalet\u201d ile \u201ce\u011fitim ve iyile\u015ftirme\u201d faaliyetlerine uygun bir psikolojik ortam\u0131n sa\u011flanmas\u0131 demektir.<br \/>\nHi\u00e7 \u015f\u00fcphe yok ki, kurumda olumlu bir psikolojik ortam \u00e7ok i\u015fe yarar. Mahpuslar\u0131n d\u0131\u015f d\u00fcnya ile ili\u015fkileri bu ortam\u0131n olu\u015fmas\u0131na \u00f6nemli katk\u0131lar sa\u011flarsa da tek ba\u015f\u0131na yeterli de\u011fildir.
